TERMS AND PROCEDURES REGISTRATION OF BRAND


1.   Application for trademark registration filed by filling out a form provided for that
2.   Made in Bahasa Indonesian and typed in 4 (four)
3.   The applicant must attach:
a.  A statement on the paper sufficiently sealed, signed by the applicant (not power), which states that the trademark being applied for is hers;
b. The special power of attorney, if the registration is filed by the authority;
c.   A certified copy of the deed or a copy of a legal entity that is certified by a notary, if the applicant legal entity
d. Some sheets label brand (4 sheets glued on a form) that is printed on paper
e.  A copy of the applicant's identity card, proof of genuine priorities and translation in Indonesian, when used with the right priorities;
f.  Proof of payment of application fee.


BRAND CANNOT BE REGISTERED BECAUSE OF THE BARAND:

1. Registered by the applicant who had bad faith;
2. Contrary to the legislation in force, religious morality, decency or public order
3. No distinguishing features;
4. It has become the common property, or
5. Is a description of or relating to the goods or services applied for registration.

THINGS THAT CAUSE A BRANDS APPLICATION MUST BE REJECTED BY DIRECTORATE GENERAL OF INTELLECTUAL PROPERTY RIGHT

1. Having similarity in principle or in its entirety with the brand belonging to another party with another party's trademark registered first for goods and / or services of that kind;
2. Having a similarity in principle or in its entirety with the well-known brand belonging to another party for goods and / or services of that kind;
3. Having a similarity in principle or in its entirety with the well-known brand belonging to another party for goods and / or services which are not similar insofar as they meet certain requirements imposed by government regulations;
4. Having similarity in principle or in its entirety with the known geographical indications;
5. It is or resembles a famous person's name, photograph, or a legal entity that is owned by another person, except upon written consent of the beneficiaries;
6. An imitation or resembles the name or abbreviation of the name, flag, emblem, or symbol or emblem of the State or national or international institution, except with the written approval of the competent authority;

7. An imitation or resembles a mark or seal or official stamp used state or government agency, except upon the written approval of the competent authority;
